How long does it take to register a company in Morocco in 2026?

The time needed for registration in the Trade Register (RC) mainly depends on three factors: the completeness of the file, the filing channel (electronic route via charikaty.com under Law 88-17 or traditional route via a fiduciary firm) and the availability of the registry of the competent Commercial Court. Moroccan law does not set a uniform binding legal deadline for registration: it organizes a one-stop shop (Law 47-18 on the CRIs) responsible for processing compliant files as quickly as possible.

Electronic route vs traditional route

Electronic route (Law 88-17)

Electronic company creation goes through the national DirectEntreprise platform, managed by OMPIC, which digitalizes the entire journey with the administrations concerned. Access to it is reserved for professionals; the founder does not file directly. Charikaty acts as a filing intermediary. Traditional route

The paper file is submitted to the territorially competent CRI. It can be drawn up as a private deed or as a notarized deed (Law 32-09). The CRI still acts as the one-stop shop toward the other administrations.

  • OMPIC negative certificate already obtained (Law 13-99) and an uncontested company name
  • Articles of association compliant with Law 5-96 (SARL) or Law 17-95 (SA/SAS as amended by Law 19-20)
  • Clear proof of registered office: commercial lease (Law 49-16) or domiciliation agreement (Law 89-17)
  • Capital blocking certificate issued by the depositary bank for cash contributions where the capital exceeds 100,000 MAD
  • Valid identity documents of the partners and the manager;
  • Advanced electronic signature (recommended) operational for all signatories (Law 43-20)

Delaying factors

  • Refusal of the OMPIC negative certificate because the name is already taken or too similar
  • Non-compliant articles of association (clauses contrary to the Commercial Code or to company law)
  • Insufficient proof of registered office (expired lease, domiciliation agreement not compliant with Law 89-17)
  • Contribution in kind without a contributions auditor's report where it is mandatory (Article 53, Law 5-96 if > 100,000 MAD or > half of the capital; always mandatory in an SA)
  • Regulated activity requiring prior sector-specific authorizations

Post-registration formalities to complete in sequence

Once the Model J / RC extract, the RC number and the ICE have been issued, the company must without delay:

  • Publish its incorporation in the Official Bulletin and in a legal announcements journal
  • Register with the CNSS upon the first hire (Dahir 1-72-184)
  • Set up its accounting in accordance with Law 9-88 (records kept for 10 years: Article 211 of the CGI 2026)
