Who owns the code I develop for a client?
By default, the author is the first holder of moral and economic rights (law 2-00, article 31). Economic rights are assignable, but only in writing: the contract can limit the assignment by rights, purposes, duration, territory and means of exploitation (articles 39 to 42). Without a written clause, your client does not own what they think they own. Our contract templates settle this.
Can I patent my software in Morocco?
No: computer programs as such are excluded from patentability (law 17-97, articles 23 to 25, cited by OMPIC). Protection goes through the copyright of law 2-00, trade secrets and well-drafted contracts. An OMPIC trademark filing does protect your name and brand.
Are my services for foreign clients VAT-exempt?
Yes, if the service is exploited or used outside Moroccan territory: exemption with deduction right (2026 Tax Code, article 92-I-1°), backed by the invoice in the foreign client's name and proof of payment in foreign currency. Note: no specific corporate tax exemption for exported IT services exists in 2026; ordinary corporate tax applies.
How do I secure the .ma for my agency or clients?
Registration goes through a registrar declared with the ANRT, on a first come first served basis (decision ANRT/DG/02/2024). The holder must have an administrative contact in Morocco, registration lasts up to 5 years, and reselling domain names is strictly prohibited. Conflicts with protected trademarks go through an alternative dispute resolution procedure or the courts.
Freelance or company for development work?
The auto-entrepreneur works solo within the regime's ceilings, but a company quickly becomes necessary: referencing with large accounts, hiring, export VAT with deduction right, and clean assignment of code rights. The SARL AU is created 3 business days after filing* and grows with you.
