Does Morocco have a Startup Act like Tunisia or France?
No. Digital Morocco 2030 is an official strategy, but no « Startup Act » creating a general startup status has been enacted. The concrete framework is the JEI of the 2026 Tax Code (article 6-IV) and the label of the Digital Development Agency, created by law 61-16. We structure your company to get the most out of it.
What concrete advantages if my startup is a labelled JEI?
Two verified levers: on the investor side, the corporate tax reduction of article 7-XII of the 2026 Tax Code (participation capped at 500,000 DH per JEI, reduction limited to 30% of the tax due, shares held 4 years); on the exchange side, the 2,000,000 DH yearly international e-commerce allowance and investments abroad up to 10,000,000 DH per year without 3 years of track record (IGOC, articles 120-121 and 184).
Is my startup tax-exempt for 4 years?
No direct corporate or income tax exemption for the startup itself exists in the 2026 Tax Code: the JEI advantage benefits the investor who enters your capital. Your startup follows ordinary law, with the progressive corporate tax rates. Your Charikaty accountant optimizes within the real framework, not an imaginary one.
Can I grant stock options to my first employees?
There is no Moroccan BSPCE or dedicated ESOP tax regime. Equity incentives are structured under ordinary company law: transfer undertakings, warrants or reserved capital increases, depending on your legal form. It is a legal setup to draft properly from day one, especially before a round.
How do I invoice my foreign SaaS clients?
Services rendered for export are VAT-exempt with the right to deduct input VAT if the service is exploited or used outside Morocco (2026 Tax Code, article 92-I-1°): invoice in the foreign client's name and proof of payment in foreign currency. The e-commerce allowance covers your tools paid abroad.
