Can I launch a guarding company without authorization?
No. Law 27-06 (article 1) reserves surveillance, guarding, protection of persons and cash transport for duly authorized persons. Operating without authorization is punished with a 5,000 to 40,000 DH fine and 2 months to 1 year in prison (article 22), with possible closure (article 29).
How do I obtain the authorization?
It is issued by the wali of the region where your head office is located (decree 2-09-97, article 1). The file includes: articles of association, appointment minutes, list of founders, directors and employees, capital allocation, lease or property title, RC forms 9 and 14 and professional insurance (article 3). What legal form is required?
A commercial company headquartered in Morocco, run or managed by an individual who is themselves authorized, employing only staff meeting the legal conditions, with professional insurance subscribed (law 27-06, article 3). The SARL or SARL AU meets these requirements. No legal minimum capital was found in the texts consulted.
What obligations for my guards?
Prior declaration of employees to the competent authority, a ban on employing persons convicted of incompatible offenses, professional aptitude and a professional card (law 27-06, articles 5 and 15). A special employee register must be kept at the head office and in every branch (article 11 of the law, article 9 of the decree).
What do staffing violations risk?
Violations of the employment rules of article 5 are punished with a 5,000 to 40,000 DH fine and 1 to 3 years in prison (law 27-06, article 24). Closure of the establishment can also be ordered (article 29). Recruitment must be locked down from the first guard.
