Opening, extending or modifying a private school requires prior AREF authorization (law 06-00, art. 2).

How do I get the authorization to open a private school?
The application is filed with the AREF (regional education and training academy): law 06-00 (article 2) requires a decision within a maximum of 30 days, silence counting as acceptance. The authorization covers the opening, but also any later extension or modification.
And for a nursery?
Law 40-04 subjects opening and operation to prior administrative authorization (article 3), based on an administrative, pedagogical and health file (article 4). The decision comes within 60 days (article 5) and the authorization is issued for 1 to 10 years (article 6). Insurance covering the children is mandatory (article 9).
Who can run the establishment?
For a school: a Moroccan director aged at least 25, enjoying civic rights, medically fit, pedagogically qualified with 3 years' experience (law 06-00, article 12); teachers must be qualified (article 14). For a nursery: permanent management and educators meeting the conditions of articles 16, 18 and 20 of law 40-04.
What tax advantages for my establishment?
Equipment goods intended for private education or vocational training are VAT-exempt with deduction right (2026 Tax Code, article 92-I-8°). No general 2026 tax exemption applicable to all school or nursery income was found in the sources consulted: ordinary law applies to the rest.
What does an unauthorized establishment risk?
For a school: a 10,000 to 50,000 DH fine, raised to 20,000 to 100,000 DH on repeat offense with a 2-to-10-year ban (law 06-00, article 24). For a nursery: 1,000 to 5,000 DH (law 40-04, article 22), sanctions for lack of insurance (article 24) and closure or authorization withdrawal (article 28).
