Do I need an authorization to open my store?
Retail is free: buying to resell is an act of commerce (law 15-95, article 6-1°). However, signage, terraces or use of the public domain may require a municipal authorization, to be checked case by case with your municipality. We review it together before opening.
Does the commercial lease really protect me?
Yes, if it is signed in your company's name. Law 49-16 gives you a right to renewal: if the landlord refuses without legal grounds, they owe you an eviction indemnity. Your Charikaty legal advisor reviews the lease before you sign.
Auto-entrepreneur or company for my store?
The auto-entrepreneur works solo under 500,000 DH of collected revenue per year (law 114-13). But a store quickly means a lease, stock, suppliers on credit and sometimes employees: the SARL secures all of that and protects your personal assets.
What payment terms with my suppliers?
Law 69-21 regulates terms between traders: 60 days by default, 120 days maximum if the contract provides for it. Late payments are sanctioned with a fine at the BAM key rate plus 0.85% per month, and failure to declare costs 5,000 to 250,000 DH (article 78-6).
What VAT for my store?
The standard 20% rate (2026 Tax Code, article 99-A). You become compulsorily VAT-liable when your previous year's taxable revenue reaches 2,000,000 DH (article 89-I-2°-b). Your Charikaty accountant sets up the right regime from registration.
