What the law expects from a recruitment agency.

Can I launch my recruitment agency without authorization?
No. Article 477 of the Labor Code reserves intermediation (placement, job-search assistance, temp work) for agencies authorized by the government authority in charge of labor. The authorization can be withdrawn by reasoned decision (article 487).
What capital and guarantees are required?
Share capital of at least 100,000 DH (article 481) and a guarantee deposited with the CDG equal to 50 times the annual overall SMIG value (article 482). The exact 2026 amount depends on the SMIG in force, which cannot be quantified without an official published decree. The file includes RC, articles, capital, bank account and CNSS registration (article 483).
Can I charge candidates?
No. Article 480 prohibits charging job seekers any fees, directly or indirectly. Your business model is built exclusively on fees invoiced to employers.
Can the agency do temp staffing?
Yes, it is within the scope of article 477: hiring employees to place them temporarily with a user who sets their tasks and supervises their execution. The authorization, capital and deposit obligations apply in the same way.
What about placing candidates abroad?
Foreign placement contracts are subject to a prior visa (article 489). In case of insolvency or authorization withdrawal, the CDG deposit can serve to pay employees or the CNSS (article 488). Your Charikaty legal advisor frames every flow before launch.
