Which online services can you use to set up a company in Morocco in 2026?
In Morocco, every step of setting up a company has an online service: OMPIC for the negative certificate [certificat négatif] (232.76 MAD online) and trademarks, the DGI and its SIMPL e-services for taxation, the CNSS and DAMANCOM for social security declarations, and the RNAE for the auto-entrepreneur. Law No. 88-17 on the electronic creation of businesses makes it possible to complete all the formalities remotely, and Law No. 43-20 gives legal value to the electronic signature. Each administration handles its own formality, while a private platform such as Charikaty brings together the entire process, from the negative certificate to the extract from the Commercial Register (Registre du Commerce, RC), without any travel.

Can you set up a company entirely online (Law 88-17)?
Yes: Law No. 88-17 (2019) makes it possible to complete all the formation formalities remotely, with an advanced electronic signature (signature électronique avancée) issued by a provider approved by the DGSSI. Among the three levels provided for by Law No. 43-20 (simple, advanced, qualified), it is the recommended level for company deeds. Each step, from the negative certificate to the RC extract, is detailed in our guide to setting up a company 100% online in Morocco.
Official deeds are still issued by the authorities: the negative certificate by OMPIC, registration in the Commercial Register by the commercial court registry (Law 15-95, Law 53-95), the IF, the ICE and the business tax by the DGI, affiliation by the CNSS. The Regional Investment Center (Centre Régional d'Investissement, CRI), the regional one-stop shop for investors, is not a mandatory step for setting up a company. With Charikaty, you complete the entire process online, from the negative certificate to the delivery of your Commercial Register extract and your identifiers.
What do OMPIC's online services allow?
The online services of the Moroccan Office of Industrial and Commercial Property (Office Marocain de la Propriété Industrielle et Commerciale) (Law 13-99) allow:
- Applying for the OMPIC negative certificate, which certifies that the company name (dénomination sociale) is available (Article 74 of the Commercial Code [Code de commerce]): 232.76 MAD online, issued in practice within 24 to 48 hours, valid for 90 days, the period within which the company must be registered.
- Filing and tracking trademarks, patents, industrial designs (Law 17-97). A trademark is protected for 10 years, renewable indefinitely.
- Consulting the central commercial register (registre central du commerce), kept by OMPIC on the basis of the local registers.
What does the DGI do online with SIMPL?
The General Tax Directorate (Direction Générale des Impôts) assigns the company, as part of its registration, its tax identification number (identifiant fiscal, IF), its ICE (15 digits, Decree 2-11-63) and its enrolment for the business tax (taxe professionnelle, TP) (Law 47-06), which is exempt for the first 5 years of operation. The SIMPL e-services then handle the mandatory online filing and online payment: IS (Article 19 of the CGI), VAT (TVA) (Articles 87 to 125), IR on salaries and minimum contribution (cotisation minimale) (Article 144, exempt for the first 36 months of operation).
How do you register online as an auto-entrepreneur (RNAE)?
An individual who carries out a small activity alone can opt for the auto-entrepreneur (self-employed status) (Law 114-13). Enrolment is done online in the national auto-entrepreneur register (registre national de l'auto-entrepreneur, RNAE), without registration in the Commercial Register and without articles of association. Turnover ceilings: 500,000 MAD (trade, industry, crafts) and 200,000 MAD (services), with a flat-rate final tax (impôt libératoire) of 0.5% or 1% of the turnover collected. Beyond that, or to go into partnership with others, a company must be set up (SARL, SAS).
What do private legal-tech platforms do?
Private platforms such as Charikaty are not administrations. They prepare the file, have it signed, file it and follow it up with the authorities, then deliver the documents to the client:
- Drafting of the articles of association (Law 5-96 for the SARL; Law 17-95 amended by Law 19-20 for the SA; Law 5-96 as amended and supplemented by Law 19-20 for the SAS) and advanced electronic signature (Law 43-20)
- Negative certificate from OMPIC
- Filing of the registration file with the registry, then delivery of the RC extract, the IF, the ICE and the TP
- CNSS affiliation and legal publications (legal announcements newspaper [journal d'annonces légales] and Official Bulletin [Bulletin officiel])
What documents, costs and timelines apply to an online formation?
Documents: identity document of each partner (associé) and director (CIN or passport), proof of the registered office (siège social) (commercial lease [bail commercial], Law 49-16, or business domiciliation contract [contrat de domiciliation], Law 89-17), negative certificate, signed articles of association, certificate of blocked capital (attestation de blocage du capital) where required, report of the contributions auditor (commissaire aux apports) in the event of a contribution in kind above the thresholds (Article 53 of Law 5-96).
