Is a dark kitchen legal in Morocco?
Yes: no text prohibits or names it. A kitchen without a dining room remains a food sector establishment subject to law 28-07: sanitary approval or authorization before operating (article 5), premises requirements (article 8), self-monitoring and traceability (articles 9 and 12). Your Charikaty company is created with the ONSSA file in parallel.
How do I obtain ONSSA approval?
The sanitary approval or authorization application is filed with the competent provincial ONSSA service, with an administrative and technical file, based on law 28-07, decree 2-10-473 and orders 2768-12 and 244-13. An approval or authorization number is issued; the timeframe depends on the competent provincial service.
What requirements for my production premises?
Article 8 of law 28-07 sets the substantive conditions: location, design, layout, equipment, operation, products, transport, staff, cleaning, disinfection and contamination thresholds. Premises up to standard from day one avoid a refused approval and emergency works.
Am I exempt from approval if I sell directly to individuals?
Article 5 of law 28-07 provides an exception for establishments whose entire production goes directly to the final consumer for their own consumption. The line is thin for a caterer delivering to platforms or companies: your Charikaty legal advisor qualifies your case before launch.
What does an unapproved kitchen risk?
Article 25 of law 28-07 punishes placing a dangerous product on the market or sourcing from a non-approved establishment when approval is required with 2 to 6 months in prison and/or a fine of 50,000 to 100,000 DH. Articles 26 and 28 also sanction non-compliant labelling and obstruction of inspections.
